The Department of Labor Wage and Hour Division has announced a series of “listening sessions” regarding various issues under the Fair Labor Standards Act. This comes on the heels of changes to the overtime provisions of the Fair Labor Standards Act promulgated by the Obama Administration but reversed by the Trump Administration before they went into effect. The most controversial of these was an increase in the minimum threshold required for an employee to be considered “exempt” from receiving overtime pay when he or she works in excess of 40 hours in a workweek. That change would have increased the minimum threshold – one of several factors involved in differentiating between an exempt and non-exempt employee – from $ 23,660 to $ 47,476.
