  • At NAHJ: Aug. 6-7, before the NAHJ Multimedia Convention & Career Expo in San Antonio
  • At ASNE/APME: Sept. 14-15, before the ASNE/APME conference in Chicago

Fighting back on excessive FERPA secrecy

 
The Family Educational Rights and Privacy Act (FERPA) has, for some time, been a serious impediment to anyone reporting on education issues, especially campus crime issues. The law is intended to prevent access to educational records -- and most of us wouldn't quarrel with the idea that a reporter or anyone else can't get access to a student's grades or transcripts -- but that definition is often extended to things that bear no reasonable relationship to the educational process (It's often invoked by university athletic departments to cover up student-athlete scandals.).

Voice your support for FOIA reform bill introduced by Senate

 
You may recall (since we circulated an alert about it) that the House of Representatives passed comprehensive Freedom of Information Act (FOIA) reform legislation last summer. However, our celebration of this key legislative action was cut short when we learned soon after that the Senate didn't intend to move the House bill, and instead Sens. John Cornyn, R-Texas, and Patrick Leahy, D-Vt., two longtime champions of FOIA and open government, were drafting their own legislation. So we set to work with these and other members of the Senate and their staff to ensure that this Senate FOIA reform bill would improve the federal FOIA in several ways.

ASNE continues push for shield law

 
A couple of weeks ago, we alerted you to the fact that the Supreme Court would be determining whether to hear The New York Times reporter James Risen's appeal from a Federal Appellate Court decision that there is no First Amendment or common law privilege, which protects a reporter from having to testify in federal court proceedings (and, for good measure, even if there were, he would likely have to testify anyway.).
